These terms and conditions apply to any use of OWNIEZ.COM, particularly to our products and sales on this website. By visiting this website or placing an order, you agree to these terms and conditions.
Definitions
- Consumer (B2C): a natural person who, not acting in the exercise of a profession or business, purchases slippers as a customer.
- Entrepreneur (B2B): any natural or legal person of a company and/or foundation.
Applicability These terms and conditions apply to purchase agreements and agreements for the design and/or production of slippers, concluded between an entrepreneur and a consumer.
Quotations Quotations, unless otherwise stated in the quotation or otherwise agreed, are valid for two weeks from the date of receipt. Quotations can be revoked by OWNIEZ BV as long as they have not been accepted by the customer.
Privacy Policy Our privacy policy provides information on how OWNIEZ uses your data. By accepting these terms and conditions, you also agree to our privacy policy.
Returns and Warranty Customized items cannot be returned unless there is a manufacturing defect or production error. All refund and exchange requests must be submitted within 30 days of receipt. Contact us at info@owniez.com with your order number and a description of the issue before returning the slippers. We will then provide further instructions for the return shipment.
We inspect each item for quality and accuracy before it is delivered to you. We guarantee that our customized slippers are free from manufacturing defects or product errors.
OWNIEZ strives for the highest quality in our products. If a customer finds that the print on the slippers does not meet expectations, the slippers can be returned within 30 days of receipt. OWNIEZ offers the following options as compensation:
- A one-time reprinting of the slippers at no extra cost.
- Replacing the slippers with blank slippers in the desired color and size.
To use this warranty, the customer must contact OWNIEZ via info@owniez.com with the order number and a description of the problem. We will then provide further instructions for the return shipment. The slippers must be returned in the original packaging.
Legal Provisions This warranty does not affect the statutory rights of the consumer as laid down in Dutch law. Consumers always retain the rights and claims they may have under applicable consumer law.
Product Information We do everything we can to describe the colors and descriptions of our slippers as accurately as possible. However, please note that the image and color quality on your screen may vary. We cannot guarantee that your screen accurately displays all features of the actual product. All prices include VAT. The dimensions are indicated in centimeters. The length is comparable to a normal shoe size. Please refer to our size chart for the correct size.
Liability OWNIEZ is not liable for any indirect or direct damage to you or third parties, including consequential damage, lost revenue and profit, loss of data, and intangible damage, related to or resulting from the agreement or the use of the products. In the event of force majeure, OWNIEZ is not obliged to fulfill its obligations under the agreement.
Own Illustrations If you use illustrations, you must be able to prove that you are the rightful owner. We will not use the illustrations provided by you for other purposes without permission. By confirming an order, you agree that you, the customer, give full permission for the use of copyrighted/trademarked designs, images, or illustrations and bear full responsibility for any subsequent legal action taken by parties associated with an infringement of copyright/trademark.
If you want to use exact Pantone/RGB colors for logos and/or illustrations, please let us know the correct codes. OWNIEZ is not liable for color deviations if we have not received Pantone/RGB/CMYK numbers.
Orders OWNIEZ only sells slippers to consumers in our webshop. This means that if you plan to purchase items not intended for personal use but for resale or as a business, you cannot place an order. If you want to commercially design and produce slippers as a company, please contact us first.
We understand that everyone makes mistakes (including us)! Please review your personal information before sending an order. Check customized slippers for size, spelling, and dates carefully. Email us at info@owniez.com if you have any questions about your order before placing it. We are unable to cancel or modify your order once it has been placed online.
IMPORTANT: OWNIEZ reserves the right to cancel your orders (B2C and B2B) if the order is deemed inappropriate for language and content.
OWNIEZ reserves the right to modify or cancel an order if prices or discounts are incorrectly displayed on the website or the order/invoice.
Payments We accept Visa, Mastercard, Maestro credit and debit cards, Paypal, and iDeal. Specify what happens if a payment is not received or is declined by the bank.
Shipping and Deliveries Shipping options depend on the most suitable carrier for us and you and the country where the slippers are delivered. Specify expected delivery times and what customers can do if delivery is delayed.
Entrepreneur (B2B)
Entrepreneur (B2B) Illustrations and Designs Illustrations and designs created and drafted by OWNIEZ may not be used for other commercial purposes. The designs and illustrations remain the property of OWNIEZ.
Entrepreneur (B2B) Design Costs for Illustrations and Designs The quotation will indicate whether design costs will be charged. Design and illustration costs will still be charged if it is decided not to proceed with production after the design process and receipt of the order confirmation. The costs for this are € 45,- per print.
Entrepreneur (B2B) Payment Conditions Unless parties agree otherwise, the amounts owed by the customer will be paid based on 50% upon approval of designs/placement of the order and 50% upon delivery of goods.
Entrepreneur (B2B) Liability OWNIEZ is not liable for any indirect or direct damage to you or third parties, including consequential damage, lost revenue and profit, loss of data, and intangible damage, related to or resulting from the agreement or the use of the products.
Entrepreneur (B2B) Display, Hooks, and Accessories A separate agreement has been drawn up for this, called ‘Bruikleenovereenkomst Owniez Flip Flops’.
Intellectual Property All content, such as images, text, and brand names, etc., on OWNIEZ.COM is protected by copyright and trademark law.
It is not permitted to use, transfer, or distribute the content of this website without written permission from OWNIEZ.COM.
Changes to the Privacy Policy The privacy policy may be changed from time to time in our services or due to changes in the law. We will ensure that any changes in the future will not negatively affect your privacy. If a situation arises that affects this, we will notify you. Indicate how customers will be informed of changes to the privacy policy (for example, via email or a notification on the website).
Applicable Law – Jurisdiction This agreement between you and OWNIEZ is exclusively governed by Dutch law. The applicability of the CISG is expressly excluded in our agreement and transactions.
